Many times we are asked to sign legal documents.  Most of us have been instructed to read those documents prior to signing.
By providing these forms in advance, my goal is to respect your right to have information prior to being asked to sign the form.  If you have information…you ask better questions…which results in helping you protect yourself by better understanding the process of home buying or selling…which should be a bottom line in any sale or purchase for the consumer.

 

Buyers Forms

Buyer Agency (Required)
Buyer Agency provides you with information about the different types of real estate representation available to the consumer authorized in South Dakota.  The agent will review these types of representation.  An agency agreement is signed between the real estate company you choose to represent you and the agent you have chosen to assist you in finding a property.  This document should be reviewed and signed by all parties prior to looking for home.  (Consumer Guide pages 4 – 8)

Counter Offer
A counter offer is meant to detail all terms of the Purchase Agreement to which one party or the other will not agree.  The document is used to reach agreement on any outstanding issues established by the buyer or seller until both parties have “agreed to agree” in writing.  Once both parties have reached agreement and the documents signed accepting the terms this document becomes an extension of the Purchase Agreement.

This form must be reviewed, completed and signed by the Buyer prior to submitting an offer.

Mediation Form

Purchase Agreement (Required)
The Purchase Agreement represents an offer to purchase a home initiated by the buyers.   An offer to Purchase is not accepted until both the buyers and the sellers have agreed in writing to all terms of the offer.  The seller may counter offer the purchase agreement and the buyer may counter offer the seller until both parties have agreed in writing.  There are specific rights and responsibilities detailed in the agreement that read and discussed with your agent prior to signing this document.  This form meets the requirements of the South Dakota Real Estate Commission. Sellers Disclosure (Required)
As a buyer you are to be provided a Sellers Disclosure prior to writing an offer on a property.  This document provides you information on the Sellers knowledge of various aspects of the home.  Use this document for formulate with your agent and additional items that you would ask about and have written answers too prior to the offer being accepted.  Please read the top and bottom of the forms carefully for additional explanations and reference the Consumer Guide.  (Page 14)
